These Terms of Use govern the use of the "Social Publisher" application (hereinafter the "Service"), provided by GoT-IT Europe / Joksch-IT (hereinafter the "Provider"), available at socialmedia.software-joksch.com.
The Service enables registered customers to connect their own social media accounts (including Facebook, Instagram, LinkedIn, TikTok, X) and to schedule and publish content via a central interface. The Provider acts as a technical intermediary between the customer account and the respective platform APIs.
A customer account is required to use the Service. The customer is obliged to provide truthful information during registration and to treat their access credentials as confidential. The customer is liable for activities under their account to the extent that they were carried out by the customer or with the customer's consent.
When connecting an external social media account, the customer authorizes the Service, via the respective platform's OAuth login process, to publish content and retrieve account information on the customer's behalf. The customer is responsible for complying with the terms of use of the respective third-party platform (Meta/Facebook, Instagram, LinkedIn, TikTok, X). The Provider has no influence over changes, restrictions, or suspensions imposed by these third-party platforms.
The Provider strives for high availability of the Service but does not guarantee uninterrupted accessibility, in particular where outages are attributable to maintenance work, force majeure, or disruptions at third-party platforms.
The Provider is not liable for content published by the customer via the Service, nor for actions or omissions of the connected third-party platforms (e.g., deletion, suspension, or rejection of posts by these platforms). Otherwise, the Provider is liable only for intent and gross negligence, to the extent permitted by law.
